The petitioner apprehends his arrest in Complaint Case No. 222 of 2014, registered for the offences punishable under Section 385 and other Sections of the Indian Penal Code. The Complainant alleged that petitioner along with other un-known accused persons came and threatened the complainant to put signature on a plain paper. The accused persons assaulted her. It is submitted that all the allegations are false and concocted. Sudha Devi executed a deed of agreement to sale on 6.8.2013 in favour of the petitioner with regard to a piece of land of Khesra No. 156 Khata No. 16 area 1 Acre 42 dicimal

Patna High Court Cr.Misc. No.37561 of 2014 (2) dt.17-03-2015 2/2 and received a consideration amount of Rs. 5 Lac. Thereafter, the complainant did not intend to execute the sale-deed and that is why this false case has been filed. It appears from Annexure-2 that Sudha Devi the complainant executed deed of agreement to sale the piece of land in favour of petitioner on 6.8.2013, thereafter, this present case was filed.

Considering the facts aforesaid the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Muzaffarpur in connection with Complaint Case No. 222 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
