JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2017 The petitioner seeks regular bail in connection with Bakhtiyarpur P.S. Case No. 437 of 2016, registered for offences punishable under Sections 324, 307 of Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of firing on the informant causing injury to him.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and further there is no eyewitness of the occurrence. It has also been submitted that though there is allegation of firing against the petitioner, however, the said firing hit the thigh of the informant, which is not a vital part of the body. Petitioner has been in custody for last six months. Heard learned A.P.P. also.

Having heard both sides, considering the fact and

No.54579 of 2017 (2) dt.16-11-2017 circumstances of the case and nature of allegation, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner on bail to his own satisfaction once charge is framed in this case.
