The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323,380,384 and 504/34 of the Indian Penal Code. It is alleged that the petitioners demanded extortion of rupees fifty thousand when petitioner no. 2 snatched gold chain of the complainant.

It is submitted by learned counsel for the petitioners that though the complaint was filed on 23.11.2013 but prior to the

Patna High Court Cr.Misc. No.37996 of 2014 (3) dt.13-04-2015 2/2 issuance of process on 19.2.2014, petitioner no. 1 filed Malsalami PS Case No. 480 of 2013 on 23.12.2013 making accusation under sections 420,406,379,341,323,504 and 506/34 IPC and section 27 of Arms Act against the complainant. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Patnacity in connection with Complaint Case No. 1427 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
