The petitioner seeks bail in Chautarwa P.S. Case No. 97 of 2017 registered under Sections 341, 323, 379 and 504/34 of the Indian Penal Code.

Petitioner is said to have assaulted on the head of the informant by means of lathi over petty brawl among the ladies of both the parties inflicting grievous injury on his head. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to ulterior motive. There was no intention to eliminate the informant as no repeated blow was given by the petitioner. Hence, offence

Patna High Court Cr.Misc. No.54445 of 2017 (2) dt.14-12-2017 2/2 under Section 307 of the Indian Penal Code is not made out against him. The petitioner has been languishing in custody since 12.09.2017. Chargesheet in the case has already been submitted. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa P.S.
