Mr. Sri Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Nasariganj (Rajpur) P.S.Case No. 36 of 2018 registered under Section 304(B)/34 of the Indian penal Code. The accusation in the F.I.R is that the informant's daughter, married with the brother of the petitioners, was living with them, as her husband was away living in Ludhiana, and used to torture her in connection with further demand of dowry. Submission is that the petitioners are brothers-in-law, younger brothers of the deceased husband and in fact, his brothers wife committed suicide.

Whereas, learned counsel appearing on behalf of the informant submits that husband is not the accused in the case

Patna High Court Cr.Misc. No.30134 of 2018(5) dt.27-07-2018 2/2 and the deceased used to live with the accused persons and they used to torture her for realizing dowry and she was killed as postmortem report reveals that she was strangulated so not a case of suicide.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioners at present is rejected. However, the trial court is directed to expedite the trial and preferably conclude the same within a year after framing of the charge.
