This application for regular bail arises out of Belaganj P.S. Case No. 386 of 2019, disclosing offences punishable under Sections 302/24 of the Indian Penal Code. The informant is son of the deceased. The dead body of the deceased was found near village Dariyapur. The informant has alleged that the petitioner no. 1, who is co-brother of the deceased as petitioner no. 2, wife of petitioner no. 1 and others were instrumental in killing of the deceased. The wife of the deceased has also been implicated.

Learned counsel appearing on behalf of the petitioner, appears to be correct in his submissions that over and above

Patna High Court CR. MISC. No.16227 of 2020(2) dt.03-06-2020 2/2 suspicion, there is no material basis to connect the petitioners with the offence alleged.

Learned Addl. Public Prosecutor appearing for the State has vehemently opposed the prayer for bail. Considering the facts and circumstances, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 386 of 2019.
