Heard learned counsel for the petitioner and learned A.P.P. for the State.
Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
As per the prosecution case, informant alleges that the informant's marriage was solemnized with Guddu Ram. Further, it is alleged that her husband and in-laws were always being tortured and beaten his sister, namely, Gita Devi (deceased) and on 16-17.12.2020, her husband and in-laws including the
Patna High Court CR. MISC. No.18219 of 2022(2) dt.09-09-2022 2/3 petitioner killed the deceased and threw the dead body in a pond.
Learned counsel for the petitioner submits that the petitioner is innocent and he has not committed any offence. It is further submitted that petitioner is the elder brother of the husband of the deceased and lives separately since eight years. Further, it is submitted that there is no specific allegation of torture or any assault against the petitioner except general and omnibus allegation against all family members of the petitioner. The specific allegation of torture and assault is against Guddu Ram, who is the husband of the deceased and the allegation of having illicit relation with Guddu Ram and Shanti Devi (wife of the petitioner) is false and concocted. It is further submitted that the petitioner is in custody since 05.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case.
Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.18219 of 2022(2) dt.09-09-2022 3/3 learned Additional Sessions Judge-IV, Kaimur, Bhabhua in connection with Sessions Trial No. 196 of 2021 arising out of the Durgawati P.S. Case No. 311 of 2020.
