Petitioner apprehends his arrest in a case filed under Section 379 of the Indian Penal Code.

It is submitted on behalf of the petitioner that he is neither named in the first information report nor is there any cogent material connecting him with stealing of the motorcycle. It is submitted that the motorcycle has been recovered from one coaccused Bhim Kumar Manjhi who has taken the name of the petitioner in his self-incriminating confessional statement which has not got any evidentiary value.

Having regard to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks

Patna High Court Cr.Misc. No.38056 of 2014 (2) dt.04-03-2015 2 / 2 from today in Siwan (T) P.S. Case No.116 of 2014, the above named petitioner, Naresh Kumar Mahto shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
