The petitioner apprehends his arrest in a case under Sections 366(A)/376/149 of the Indian Penal Code. The informant lodged the case against the petitioner for kidnapping his niece.

It is submitted that the victim made her statement under Section 164 Cr.P.C. and she disclosed her age to be 19 years. The court also assessed her age to be 20 years. The victim herself stated that she solemnized marriage with the petitioner and she wanted to live with the petitioner.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt

Patna High Court Cr.Misc. No.37588 of 2014 (2) dt.18-03-2015 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Hisua P.S. Case No. 134/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
