2. Learned counsel for the petitioners submits that vide order dated 09.01.2024, the petitioner no.3 was granted anticipatory bail as he was ready to return Rs. 68,000/- to the informant, but the informant did not receive the said amount despite receiving notice issued by the learned Court below. Thereafter, petitioner no.3 requested the learned Court below either to accept the demand draft of Rs. 68,000/- or he be allowed to deposit the same before the Nazarat, but learned
Patna High Court CR. MISC. No.23218 of 2024(2) dt.20-03-2024 2/2 Court below did not accept the bail bond of the petitioner as this Court has directed to the learned Court below to accept the bail bond of petitioner no.3 after verifying that the aforesaid amount has been returned to the informant.
3. On the grounds mentioned in the modification application and in the interest of justice, I deem it proper to grant liberty to the petitioner no.3 to deposit the aforesaid amount in the Nazarat and the period to surrender before the learned Court below is extended by three weeks from today in respect of petitioner no.3 in connection with Banshi P.S. Case No. 52 of 2023, pending in the court of learned Additional Chief Judicial Magistrate-I, Arwal.
