Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The petitioner is elder brother of the husband of the victim.
Submission is that marriage of the victim was solemnized 20 years ago. Hence, presumption of dowry death is not there and there is no specific attribution against the petitioner nor anyone has seen the occurrence. Considering the aforesaid fact, a Coordinate Bench of this Court has granted anticipatory bail to some other co-accused in Cr.Misc.No.38880 of 2018.
Patna High Court Cr.Misc. No.47966 of 2018 (2) dt.20-08-2018 2/2 Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Uchakagaon Police Station Case No.127 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
