JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2020 Heard Ms. Bela Singh, learned counsel for the petitioner and Mr. Anil Kumar, learned APP for the State. The petitioner, who is in custody since 08.01.2020 and is a person of clean antecedents, seeks bail in connection with Bhagwanpur P. S. Case No. 3 of 2020 dated 07.01.2020 / G. R. No. 240 of 2020 instituted for the offences under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25 (1-B)a, 26 and 35 of the Arms Act, 1959.

From the possession of the petitioner, one mobile phone, one motor-cycle and a loaded country-made pistol has been recovered.

Patna High Court CR. MISC. No.20005 of 2020(2) dt.24-06-2020 2/2 The petitioner denies that the aforesaid articles were recovered from his possession. He has only been arrested on mistaken identity.

Regard being had to the period of custody of the petitioner and the nature of accusation, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Vaishali in connection with Bhagwanpur P. S. Case No. 3 of 2020 dated 07.01.2020 / G. R. No. 240 of 2020.

The petition stands allowed.
