19-09-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 02.02.2018. Learned counsel for the petitioner has pointed out that the petitioner is in custody since 11.03.2017 and the quantity allegedly seized from his possession was less than the commercial quantity. It is also pointed out that petitioner has no criminal history.

In that view of the matter, this court directs release of the petitioner namely, Md. Naushad, on bail on furnishing bail bond of a sum of Rs. 15,000/- (Rs. Fifteen Thousand only)

Patna High Court Cr.Misc. No.50539 of 2018 (2) dt.19-09-2018 with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhubani, in connection with Madhubani Town P.S. Case No. 65 of 2017, subject to condition under Section 437(3) of the Code of Criminal Procedure.
