The petitioners are apprehending their arrest in connection with Mansi P.S.Case no.26 of 2017 registered for offences punishable under Sections 364/34 of the Indian Penal Code.

Allegation against the petitioners is that they have taken the husband of the informant in spite of her protest, thereafter her husband has not returned and when she inquired about the same, they abused her, as such she suspects that her husband has been kidnapped and killed.

Submission of the learned counsel for the petitioners is that except suspicion there is nothing against the petitioners and they have no criminal antecedent.

Patna High Court CR. MISC. No.17166 of 2019(3) dt.03-05-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail stating that petitioners are named in the FIR and they along with others have taken her husband and apart from that the impugned order itself shows that in some paragraphs the witnesses have supported the occurrence. .

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners. With the aforesaid direction, this application is dismissed.
