JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Mirganj P.S. Case No. 328 of 2019, registered under Sections 341, 323, 498(A) and 504/34 of the Indian Penal Code. The accusation is that Anil Prasad (petitioner), husband of the informant, stopped to provide expenses of the informant Sandhaya Gupta due to illicit relation with his sister in law, namely, Joyti Gupta and her husband Anil Prasad (Petitioner) also used to abuse and assault her. The petitioner also forbade his children not to talk with her. On 22.12.2019, her husband Anil Prasad (Petitioner) and her Gotani Joyti Gupta assaulted her locking in the room in which she sustained injury.

No.16601 of 2020(2) dt.27-05-2020 2/2 Learned counsel for the petitioner submits that petitioner is the husband of the informant Sandhaya Gupta and she lodged the present case mere on suspicion on having illicit relation by the petitioner to his sister in law co-accused Joyti Gupta. Further submission is that petitioner is in custody since 28.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-XVI, Gopalganj in connection with Mirganj P.S. Case No. 328 of 2019.
