JUSTICE RAKESH KUMAR ORAL ORDER 18-08-2018 Heard Sri Bijay Bhushan Prasad, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, having clean antecedent and in custody since 29.06.2018, has prayed for grant of bail in connection with Naubatpur P.S. Case No. 159 of 2018, registered for the offence under Sections 147, 148, 149, 341, 323, 307, 354-A, 504/506 of the Indian Penal Code , 1860 ( hereinafter referred to as the "I.P.C.").
Learned counsel for the petitioner by way of referring to the F.I.R. as well as F.I.R. lodged from the petitioner's side i.e. Annexure -2 has argued that in between informant and petitioner's side of the present case there was land dispute and from both sides cases were lodged. According to learned counsel for the petitioner on trivial issue a case has been
Patna High Court Cr.Misc. No.48211 of 2018(2) dt.18-08-2018 2/2 made out as if petitioner was involved in commission of offence under Section 307 , 354 -A and other allied Sections of the I.P.C.
Considering the facts and circumstances as well as the fact that there was case and counter case in between the parties primarily in respect of dispute of passage , there is no reason to further detain the petitioner.
Let the petitioner - Lallu Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand ) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Danapur / concerned court in connection with Naubatpur P.S. Case No. 159 of 2018.
