====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 2.6.2018, seeks bail in Mohammadpur PS Case No. 121 of 2017 registered under Sections 147, 148, 149, 341, 323, 325, 307 and 379 of the IPC. Accusation is that the accused persons were assaulting the members of the informant's family, when the informant intervened he was also badly assaulting causing injury in his eye and other parts of the body.

Learned Counsel for the petitioner submits that both sides are neighbours, there is no specific accusation against the petitioner, there is general and omnibus allegation against all the five accused persons of making assault, however the injuries have been found simple in nature except injury in the eye of the informant but that is not attributed to the petitioner and he has clean antecedent. Having considered the said facts and circumstances, the petitioner, namely, Dhananjay Kumar @ Dhananjay Mahato is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM I, Gopalganj in connection with Mohammadpur PS Case No. 121 of 2017.
