The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

It is alleged in the written report that some unknown persons caused injury on the neck of father of the informant by sharp cutting weapons who subsequently died.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Nadir Ali who has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 15521/2019. No

Patna High Court CR. MISC. No.16512 of 2020(5) dt.21-06-2022 2/2 other substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. By filing supplementary affidavit, it is submitted that the petitioner has got criminal antecedent as he is an accused in some other criminal case.

Considering the nature of allegation, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate West Champaran, Bettiah in Bairia Police Station Case No. 168/2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
