====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.6.2017, seeks bail in Barauni PS Case No. 151 of 2017 registered under Sections 387, 307, 120B & 34 of the IPC and Section 27 of the Arms Act. Accusation is that the petitioner along with two other coaccused chased the informant as he was not yielding to the demand of extortion of ten lakh rupees made by other accused so he made attempt to his life and his two pillion riders shot at the informant and escaped and it is alleged that all the accused persons are members of the criminal gang and making demand of extortion.

Learned Counsel for the petitioner submits that accusation of opening fire is not against the petitioner rather against two pillion riders and the petitioner has been in custody for more than a year. Whereas learned Counsel for the State submits that the petitioner has also participated actively and his pillion riders on the motorcycle opened firing in connection with realising demand of extortion and the petitioner has a number of criminal cases of serious nature.

Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J) U T
