The petitioner is accused in connection with Amnour P.S. Case No. 193 of 2018 registered under sections 302, 120(B) of the I.P.C. and section 27 of the Arms Act pending in the Court of A.C.J.M.-II, Saran at Chapra.

Submission of learned counsel for the petitioner is that the allegation of firing is alleged against the co-accused. Further submission is that the petitioner is in custody since 10.12.2018.

Learned counsel appearing on behalf of the informant opposed the prayer of the petitioner by contending that as per the first information report itself the petitioner came at the place

No.16746 of 2019(4) dt.22-07-2019 2/2 of occurrence on his motorcycle with the accused, who fired upon the deceased, and thereafter, this petitioner made him escape from there on his motorcycle. That shows the direct involvement of the petitioner in the alleged murder. He further submits that the petitioner had concealed his criminal antecedent. When the informant appeared and informed this Court about the criminal antecedent of the petitioner, only thereafter, a supplementary affidavit was filed on behalf of the petitioner accepting the said fact.

Having considered the nature of allegations levelled, the direct involvement of the petitioner in the alleged crime and the fact of concealing the criminal antecedent, this Court is not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
