JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in connection with Madhepura Mahila P.S. Case No. 52 of 2022 registered for the offence punishable under sections 341, 323, 376D, 420, 504, 506,34 of the Indian Penal Code.

As per allegation in the FIR, petitioner is manager of Ganga Hotel, Madhepura and he sexually exploited the informant several times in connivance with other co-accused persons there. It is further alleged that he threatened the informant to make her photo viral on social media. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Informant is a married and matured lady. Petitioner has no concern with other co-accused persons. Entry of the informant is not

Patna High Court CR. MISC. No.18992 of 2023(3) dt.18-07-2023 2/2 mentioned in the booking register of the alleged hotel. Informant's husband has not registered any complain or sanha before any police station for missing of her wife. Informant implicated the petitioner in the instant case due to ulterior motive. Only with a view to grab the money and mentally harass the petitioner, the present case has been filed by the informant with concocted story. Petitioner has got no criminal antecedent and languishing in judicial custody since 5.1.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura in connection with Madhepura Mahila PS Case No. 52 of 2022.
