JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 201 and 120B of the Indian Penal Code and Section 7 of the Essential Commodities Act.
It is alleged that initially with accusation of black marketing, Noorsarai P.S. Case No. 26 of 2015 was registered against the petitioner being the fertilizer dealer and shop of the petitioner was sealed but on opening of the seal subsequently, it was found that the seized fertilizers were changed. It is submitted by learned counsel for the petitioner that the moment the shop was sealed, it was in the possession of sealing authority and the accusation has been levelled only on suspicion. Even assuming the accusation, at best, the case under
Patna High Court Cr.Misc. No.29932 of 2015 (2) dt.29-07-2015 2/2 Section 201 IPC is made.
Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda in connection with Noorsarai P.S. Case No. 47 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
