None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.

18-08-2018 Heard Sri Jitendra Prasad Singh, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner has prayed for grant of bail in Parsa Bazar P.S. Case No. 263 of 2017 registered for offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

Learned counsel for the petitioner submits that ofcourse in the present F.I.R., the informant had alleged that the firing made by this petitioner hit the son of the informant, but fact remains that on the same date, two persons were done to death. In respect of death of another person, an F.I.R. was lodged, in which, it was alleged, as if, firing was made by one Ballam Paswan, which hit the son of informant in that case and

Patna High Court Cr.Misc. No.49147 of 2018(2) dt.18-08-2018 2/2 also one another person i.e. son of the informant in the present case.

It is evident that on the occasion of 'Grih Prawesh' of the petitioner's house, dance programme was organised and in the said programme, firing was made by the petitioner, as per present F.I.R., which hit the son of the informant. Considering the fact that in the F.I.R., there is specific accusation against the petitioner, there is no reason to pass favourable order.

The prayer for bail stands dismissed.
