JUSTICE SANDEEP KUMAR ORAL ORDER 15-11-2022 Heard Mr. Nagendra Rai for the petitioner and Mr. Rajesh Ranjan for the private respondent nos. 5 to 45 and learned counsel for the State for respondent no. 1 to 4. This is a consent order passed after hearing all the parties.

The D.C.L.R., Dehari, Rohtas is directed to decide the Bataidari Case No. 01/1994-95 afresh in accordance with various provisions of the B.T. Act and in accordance with law without being influenced /prejudiced by any observation in any other earlier order passed between the parties. The D.C.L.R. will hear all the concerned parties and, thereafter, a final order shall be passed. Any interim prayer shall be made before the D.C.L.R.

While deciding the matter, the D.C.L.R. will also consider the order dated 22.05.2015 passed in C.W.J.C. No.

Patna High Court CWJC No.6506 of 2022(3) dt.15-11-2022 2/2 5473 of 2007 (Annexure-7).

With the aforesaid observation and direction, this application is disposed of.
