JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 The case diary of Bajpatti P.S. Case No. 196 of 2013 long with a certificate of the victim the school where she is studying, was called for vide order dated 18.03.2015 but due to dismissal of the application for default, the case diary has returned. Now the application is being heard today on merit. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A and 379 of the Indian Penal Code.
The accusation is of kidnapping the minor granddaughter of the informant. In 164 Cr. P.C. statement, the victim stated that she was being abducted by this petitioner and kept at Chandigarh for one month.
It is submitted by learned counsel for the petitioner that as per medical assessment, victim is aged about 19 years and no

The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Bajpatti P.S. Case No. 196 of 2013 pending in the court of learned SDJM, Pupri at Sitamarhi. Accordingly, the application is disposed of.
