The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant alleged that while he was constructing house on his land the petitioners came and assaulted him, his wife and daughter with different weapons. There is a counter version being Fatehpur P.S. case No. 97/15 in which petitioner No.2 is informant and he also made allegation that the informant and his family members assaulted him and others. On perusal of the injury report of informant, Shyamnandan Yadav, his wife and daughter it appears that they got lacerated wounds which are simple in nature. Considering the facts aforesaid, the nature of allegations made against the petitioners, the above named
Patna High Court Cr.Misc. No.30560 of 2015 (2) dt.29-07-2015 2/2 petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar Pandey, learned Judicial Magistrate, 1st class, Gaya in Fatehpur P.S. Case No. 98 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
