16-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Mokama P.S. Case No. 271 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per F.I.R., the allegation against petitioner is that he assaulted informant by means of iron rod, due to which, he received head injury and felt down.

It is submitted on behalf of petitioner that there is case and counter case. Both sides are gotiya and due to land dispute, some scuffle took place in between the parties and both sides sustained injury. From the petitioner's side also, a complaint was lodged, vide Complaint Case No. 847 C of 2019 (Annexure -3). As per injury report of informant (Annexure 2), he received

Patna High Court CR. MISC. No.16092 of 2020(2) dt.16-07-2020 2/2 two injuries on his head and both injuries have been found to be simple in nature by the doctor. In fact, petitioner is cousin brother of informant and he has no criminal antecedent. Considering the aforesaid facts and circumstances, the bail application is allowed.

In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - IV, Barh (Patna) in connection with Mokama P.S. Case No. 271 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
