JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341 and 302 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that co accused Chhote Lal started pressing the neck of the father of the informant when informant and his brother came to rescue then some unknown accused threatened them on pistol point. Thereafter, co accused Haribansh Singh fired from pistol causing injury on the head of the father of the informant. Co accused Bachcha Singh and Motilal Singh assaulted with dagger to the father of the informant. The father of informant succumbed to the injuries. The petitioner is not named in the FIR but his complicity transpired during
Patna High Court Cr.Misc. No.31262 of 2015 (2) dt.31-07-2015 2/2 investigation.
It is submitted by the learned counsel for the petitioner that on the basis of suspicion the petitioner has been roped in the present case.
From perusal of the FIR, it appears that there is no accusation levelled against the petitioner but since the petitioner has criminal antecedent, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Kateya P.S. Case No. 228 of 2013 pending in the court of learned C.J.M. Gopalganj.
This application is disposed of with the aforesaid observation/direction.
