Petitioner apprehends his arrest in connection with Danapur P.S.Case No. 377 of 2018 registered for the offences punishable under Sections 468, 465, 471, 409 and 420 of the Indian Penal Code.

Allegation as per FIR is that on opening of T.D. account for five years the informant has deposited an amount of Rs.4 lakhs in Danapur Cant. Post Office and petitioner is said to be the Field Post Master and after maturity the informant came to know that the amount has been transferred to some other account. Submission of learned counsel for the petitioner is that petitioner is ready to deposit the total amount of Rs.6,27,074/- including interest, which will appear from a letter of Director,

Patna High Court Cr.Misc. No.48184 of 2018 (2) dt.23-08-2018 2/3 APS, addressed to the informant, in instalment if some reasonable time is granted to him.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, surrender within a period of six weeks from the receipt of this order along with a Bank Draft of Rs.2,27,074/- payable to the informant and if such amount is deposited, learned court below will release him on provisional bail for a period of two months and petitioner shall continue to pay the rest amount of Rs.4 lakhs in two equal instalments payable in 1st week of next month though Bank Draft payable to the informant. Once the total amount is deposited, learned court below will confirm his bail bond and failure to pay any of the instalments, his bail bond shall be cancelled. It is made clear that the aforesaid deposit will be subject to the result of this case.

With the above observation, this application is disposed of.
