BADAR ORAL ORDER 19-05-2023 The applicant/accused in Crime No. 197 of 2022 registered with Bhagwanpur Police Station for the offences punishable under Sections 395/397 of the Indian Penal Code, by this application is seeking his release on bail during pendency of the trial after filing of the charge sheet.
2. Heard the learned counsel appearing for the applicant/accused as well as learned Additional Public Prosecutor appearing for the State.
3. The subject crime is registered on the basis of FIR lodged by Bipin Sah of Mukund Jewellers. He alleged that four dacoits entered in his jewellery shop and at the gun point had looted gold and silver jewellery costing Rs.6,11,000/- from his shop.
4. Name of the applicant is stated to have been
Patna High Court CR. MISC. No.19121 of 2023(2) dt.19-05-2023 2/3 surfaced on the record of investigation from confessional statement of Guddu Kumar. It is stated that there is no other evidence to connect the applicant to the crime in question and nothing is recovered from him.
5. As the investigation of the subject crime is over, further pretrial detention of the applicant is not warranted and, therefore, the order :- i. The application is allowed.
ii. The applicant/accused in Crime No. 197 of 2022 registered with Bhagwanpur Police Station be released on bail on executing P.R. bond of Rs.10,000/- (Rupees Ten Thousand) and on furnishing two sureties of the like amount each to the satisfaction of the trial court i.e., Judicial Magistrate, 1st Class, Begusarai, with the following conditions: - (I) The applicant/accused should not extend any threat, promise of inducement to the persons acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer. (II) The applicant/accused should cooperate the trial court in expeditious disposal of the trial against him. (III) The applicant/accused should not contact the members of the prosecuting party as well as witnesses in this
