2. The accused/petitioner is not named in the FIR and apprehending his arrest in connection with Gobindganj P.S. Case No.253 of 2024 registered under Sections 413 and 414 read with 34 of the Indian Penal Code.

As per FIR, a truck bearing Registration No.WB11-D-2888 found loaded with cables, which alleged to be stolen and belongs to Bharat Sanchar Nigam Limited (in short 'BSNL'), where some persons were named as accused persons on the basis of disclosure made by the driver of the truck along with 20-25 unknown persons.
4. It is submitted by learned counsel that petitioner
Patna High Court CR. MISC. No.20581 of 2025(2) dt.23-04-2025 2/3 was not named with FIR. Neither his name was disclosed by the driver of the truck, which appears disclosing the name of several co-accused persons involved in the occurrence. It is pointed out that merely on the basis of suspicion raised by local Choukidar as petitioner found roaming on motorcycle near the loaded truck, which appears visualized from the C.C.T.V. footage installed over there, his name transpired in the present case. While concluding argument, it is pointed out by learned counsel that in actual the name of petitioner is Isfan Ansari, whereas the suspicious persons, who found visual in C.C.T.V. footage was Mohan Ansari. Despite of that, the police is regularly visiting the house of this petitioner to arrest, as the FIR was lodged against 20-25 unknown persons. It is submitted that petitioner is a man of clean antecedent.
5. Learned APP opposes the prayer for anticipatory bail.
6. In view of aforesaid factual submissions and by taking note of fact as name of petitioner transpired on the basis of suspicion arising out of CCTV footage, where

No.20581 of 2025(2) dt.23-04-2025 3/3 identification of petitioner also appears disputed, who is a man of clean antecedent, accordingly, the petitioner, abovenamed, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, or Successor Court, East Champaran at Motihari in connection with Gobindganj P.S. Case No.253 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC./under Section 482(2) of the BNSS.
