JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. At the very outset, it is informed that petitioner No. 1 has already been arrested and accordingly; the prayer for anticipatory bail of the petitioner No. 1 stands dismissed being infructuous.
Petitioner Nos. 2 & 3 apprehend their arrest in connection with Complaint Case No. 279 of 2011 registered for the offence under Sections-498(A), 323 of the Indian Penal Code. So far as the petitioner No. 2 is concerned; she happens to be cousin mother-in-law and similarly, petitioner No. 3
Patna High Court Cr.Misc. No.34508 of 2014 (2) dt.19-02-2015 2/2 happens to be cousin brother-in-law of the complainant and no specific overt act has been attributed against them. Considering the aforesaid facts and circumstances as well as submission of the parties, let petitioner Nos. 2 & 3 namely, Kiran Devi and Chandan Yadav @ Chandan Kumar respectively, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 279 of 2011 to the satisfaction of Sub Divisional Judicial Magistrate, Madhepura.
