Petitioner prays for bail in connection with Phulparas P.S.Case No. 61 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the accused persons, including the petitioner is that they have surrounded the deceased and specific allegation of assault to the deceased is against other co-accused. Submission of learned counsel for the petitioner is that there is no specific allegation of assault against the petitioner and he is in custody since 4.5.2018.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail on the ground

Patna High Court Cr.Misc. No.48369 of 2018 (2) dt.03-10-2018 2/2 that petitioner earlier threatened the deceased and there is allegation of accused persons of assault to the deceased. Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, in connection with Phulparas P.S.Case No. 61 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
