2. The petitioner is in custody since 05.02.2020 in connection with Mohammadpur P.S. Case No. 24 of 2020 for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act.
3. It is submitted that the petitioner has been falsely implicated in connection with recovery of 20 litres of raw spirit from a motor cycle. It is submitted that the offending goods were not recovered from the conscious possession of the petitioner and he has no concern with the motor cycle in question.
4. Learned APP appears and submits that the petitioner is accused in two prior cases of similar nature.
5. Be that as it may and having regard to the period of
Patna High Court CR. MISC. No.16171 of 2020(2) dt.13-05-2020 2/2 custody already suffered since 05.02.2020, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge II-cumSpecial Judge (Excise Act), Gopalganj in connection with Mohammadpur P.S. Case No. 24 of 2020, if he is not otherwise required in any other case.
