The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 34 of the I.P.C. and Sections 30(a), 38, 41 of Bihar Prohibition and Excise Act.

223.56 liters of foreign liquor of different brands has been recovered from a truck and petitioner is alleged to be one of the traders, indulged in sale and purchase of illicit liquor. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the alleged truck and has got clean antecedent.

Considering the nature of allegation and clean

Case No. 134 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
