JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 31.01.2022, charge-sheet has been submitted in the case and has antecedent of three cases. Allegation is of recovery of 115.560 litres of liquor from a scooty being driven by Prakash Kumar.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by Prakash Kumar, who was arrested, which has no evidentiary value.

Patna High Court CR. MISC. No.19235 of 2022(2) dt.22-04-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 31.01.2022, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kudhani (Turki O.P.) P.S. Case No. 629 of 2021.
