02.09.2020 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Arun Kumar, learned APP for the State.
The petitioner seeks bail in connection with Sahebganj P. S. Case No. 311 of 2018 dated 22.08.2018, instituted for the offences under Sections 363, 364, 365 and 34 of the Indian Penal Code. The son of the informant was called by Naresh Sahani on 20.08.2018 on some pretext. Later, the son of the informant telephonically informed him that Naresh Sahani, Mukesh Sahani and Bhola Sahani along with their father are also with him. Along with the aforesaid
persons, the petitioner and Dinesh Giri were also present.
There appears to be some dispute regarding transaction of money.
The learned counsel for the petitioner has submitted that except for the aforesaid statement in the F.I.R., no other material has come during the course of investigation to connect the petitioner with the offence. The petitioner is in custody since 23.01.2020. It has further been stated that one of the accused persons, namely, Naresh Sahani has been granted bail by a Bench of this Court vide order dated 08.05.2019 passed in Cr. Misc. No. 5624 of 2019. Regard being had to the nature of accusation and the fact that one of the co-accused persons with similar allegations has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the
satisfaction of the learned A.C.J.M. 1st (W), Muzaffarpur, in connection with Sahebganj P. S. Case No. 311 of 2018.
This petition stands allowed.
