JUSTICE SATYAVRAT VERMA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 21.01.2022, charge-sheet has been submitted in the case and has antecedent of six cases. Allegation is of recovery of recovery of 1.875 litres of liquor from a bush.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case because of his antecedents as recovery was not made from his conscious possession.

Patna High Court CR. MISC. No.18462 of 2022(2) dt.15-04-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and the alleged recovery of liquor is from the bush, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajgir P.S. Case No. 41 of 2022.
