ANJANA MISHRA ORAL ORDER 06-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Baikunthpur P.S. Case No. 166 of 2014, registered for offences punishable under Sections 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that though general and omnibus allegations has been made against the petitioners, the postmortem report reveals no sign of external injury upon the body of the deceased. It is further submitted that similarly situated persons Akhilesh Mishra and Pawan Mishra who were made the main accused in the case have been extended the privilege of anticipatory bail in Criminal Miscellaneous No.

Patna High Court Cr.Misc. No.32309 of 2015 (5) dt.06-01-2016 2/2 15304 of 2015 vide order dated 26.05.2015.

Considering the aforementioned facts and circumstances of the case and also the fact that these petitioners have clean antecedents, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 166 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) sunil/- U T
