Petitioner, already in custody, seeks bail in connection with Ballia P.S. Case No.135 of 2018, registered under Sections 401, 413, 420, 406 and 34 of the Indian Penal Code. Accusation is that on suspicion the petitioner and others were apprehended and suspected to exchange the ATM of customers at the time of withdrawal of money and one ATM Card of PNB was recovered from his possession and there is no evidence that the ATM of any person was exchanged by the petitioner by playing fraud and he has also no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Rahul Kumar is directed to be released

Patna High Court Cr.Misc. No.48664 of 2018(2) dt.07-08-2018 2/2 on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Ballia P.S. Case No.135 of 2018.
