2. There is no appearance of O.P. No. 2, despite valid service of notice.
3. The petitioner, happens to be husband of the O.P. No. 2, apprehends his arrest in connection with Complaint Case No. 493 of 2024, registered for the offences punishable under Sections 115 and 85 of the B.N.S. Act and Sections 66(A) & 66(E) of the I.T. Act.
4. Allegedly, the marriage of the petitioner was solemnized with O.P. No. 2 on 07.05.2019. However, right from the inception, the accused person, including the petitioner, were kept on demanding dowry, and on account of non-fulfillment of
Patna High Court CR. MISC. No.23737 of 2026(3) dt.15-07-2026 2/3 the same, she was tortured in various ways, and finally, the accused persons snatched the jewelries and the valuable of the O.P. No. 2, and ousted her from the matrimonial house. The Panchayati also could not resolve the dispute.
5. Learned Advocate for the petitioner submitted that the petitioner has all along been ready to keep the O.P. No. 2 with full honour and dignity, but on account of reasons unknown to him, she is not willing to reside. So far the allegation of making some obscene photographs as viral, the same has been refuted, and it is submitted that the prosecution has not come out with a cogent material that the photographs have been made viral through the mobile of the petitioner. He further submits that the petitioner, being husband of O.P. No. 2, who has been ready to keep the O.P. No. 2 as his wife, there is no chances that he will tarnish the reputation of his own wife.
6. On the other hand, the learned Advocate for the State opposed the pre-arrest bail application and submits that the conduct of the petitioner appears to be quite immoral. Besides, there is a specific accusation of demand of dowry and causing torture
7. Regard being had to the submissions made on behalf of the parties and considering the nature of accusation, coupled with the fact that the petitioner has all along been ready

No. 2, as his wife, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh in connection with Complaint Case No. 493 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
8. It is further directed that if the O.P. No. 2 shall ensure her physical appearance before the learned jurisdictional Court and file an application that she is also ready to reside with the petitioner and resolve the dispute, in such circumstances, the petitioner shall also ensure his presence, whereupon the learned jurisdictional Court shall take all endeavours to reconcile the dispute between the parties.
