The petitioner seeks pre-arrest bail in connection with Lauriya P.S. Case No.84 of 2016 registered under Sections 420 and 409 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the allegation that he did not hand over the charge of documents relating to appointment of Panchayat teachers recruited in the year 2006 is absolutely false for the reason that he was posted in the Belwa Lakhanpur Panchayat in the year 2011 and since then he has not been handed over the charge of documents relating to appointment for which he also sent complaint to the

Patna High Court Cr.Misc. No.58856 of 2017 (2) dt.13-12-2017 2/2 Block Development Officer repeatedly. He submitted that there is no reason for the petitioner not to hand over the charge of the documents relating to appointment with which he had no concern. Despite copy having been served to the office of the Advocate General, learned Additional Public Prosecutor for the State did not turn up to contest the application filed by the petitioner.

Having regard to the allegations and the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st Class, Bettiah, West Champaran in connection with Lauriya P.S. Case No.84 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
