JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Khajauli PS case no. 80 of 2017 registered for the offences punishable under Sections 399, 402, 419 of Indian Penal Code and 25(1-b)A, 26, 35 of Arms Act.

The case of the prosecution is that when the police got information about some people having assembled for the purposes of committing crime, they had conducted raid and apprehended the accused persons including the petitioner herein whereupon as far as the petitioner is concerned, from his possession only one Nokia mobile was recovered. The learned counsel for the petitioner submits that the petitioner has got no criminal antecedent, no incriminating

Patna High Court Cr.Misc. No.49875 of 2017 (2) dt.17-10-2017 2/2 article has been recovered from his possession and he is languishing in custody since 29.07.2017.

For the reasons stated hereinabove, the petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial MagistrateIII, Madhubani in connection with Khajauli PS case no. 80 of 2017.
