The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 469, 471 and 470/34 of the IPC and Section 3 of Damage to Public Property Act.

The prosecution case is to the effect that the petitioner was making illegal construction over the land, which belongs to Bihar State Housing Board.

It is submitted by learned counsel for the petitioner that the petitioner is a retired army personnel and now he is employed as Special Action force (S.A.F.) It is further submitted that the petitioner has no concern either with the alleged construction or

Patna High Court CR. MISC. No.16764 of 2019(2) dt.26-03-2019 2/2 with the land in question. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner was illegally making construction over the land, which belongs to the Bihar State Housing Board.

Considering the fact that the petitioner does not claim the alleged construction or the land in question, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIII, Patna in connection with Rajeev Nagar P.S. Case No. 326 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
