Mr.Shailendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-05-2025 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Gaya Muffasil P.S. Case No. 315 of 2024, registered for the offences punishable under Sections 302, 34 of the Indian Penal Code.

3. The petitioner, along with co-accused, allegedly called the informant's son from his home and later murdered him, following prior death threats.

4. The learned counsel for the petitioner has submitted that the witnesses in paragraph nos. 11, 12, 13, and 14 of the case diary have stated that the deceased, while attempting to enter the newly semi-constructed house of Ajay Kumar Prasad, died as a cemented slab fell on him. The statements of these witnesses are corroborated by the investigating authorities and

Patna High Court CR. MISC. No.17523 of 2025(3) dt.13-05-2025 2/2 in the supervision note, it has also been mentioned that the deceased was trying to enter the house of Ajay Kumar Prasad by taking support of the slab, which fell on him and caused his death.

5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that the family members of the deceased have supported the prosecution case.

6. Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Gaya Muffasil P.S. Case No. 315 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
