JUSTICE RAKESH KUMAR ORAL ORDER 18-08-2018 Heard Sri Manish Kumar No. 2, learned counsel for the petitioner. None appeared on behalf of the State, whereas, Sri Prabhakar Singh, learned counsel , has appeared on behalf of the informant to oppose the prayer for bail.

The sole petitioner, who is in custody since 21.06.2018, has prayed for grant of bail in connection with Moffasil P.S. Case No. 13 of 2018, registered for the offence under Sections 406, 420 and 34 of the Indian Penal Code, 1860. Learned counsel for the petitioner by way of referring to contents of the F.I.R. as well as legal notice sent on behalf of the informant submits that in a case pertaining to dispute of civil nature criminal case has been instituted and petitioner is languishing in jail since long, however, Sri Prabhakar Singh,

Patna High Court Cr.Misc. No.48850 of 2018(2) dt.18-08-2018 2/2 learned counsel for the informant has vehemently opposed the prayer for bail. He further submits that petitioner is accused in relation to almost similar accusation in other cases also. However, after going through the materials available on record, nature of accusation and period of custody, I am of the opinion that it is a fit case for granting bail.

Accordingly, let petitioner - Sarvesh Kumar @ Viki Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya / concerned court in connection with Moffasil P.S. Case No. 13 of 2018.
