JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 12-04-2019 The petitioner, who had worked as Medical Social Worker and had superannuated from the same post in the year 2013, is aggrieved by the fact that he has not been paid the arrears of difference of salary upon 6th pay revision and the benefits of first and second ACP.

2. It has been submitted on behalf of the petitioner that the payment of salary in tune of his pay revision has not yet been sanctioned in case of the petitioner and other similarly situated persons without any reason. The efforts of

3. The petitioner has been representing before the Additional Chief Medical Officer, Bhagalpur, the District Magistrate, Bhagalpur and others, but to no avail.

Considering the fact that the petitioner has retired in 2013 and till date he has not been paid the amount to which he is entitled, this Court deems it appropriate to direct the petitioner to make a fresh representation before the Additional Chief Medical Officer, Bhagalpur (respondent No. 3) along with the details of the payment to which he is entitled within a period of four weeks. Should such a petition be filed within the aforesaid period, the Additional Chief Medical Officer, Bhagalpur (respondent No. 3) shall look into the matter, verify the facts and after inquiring about the eligibility of the petitioner for receiving such payment, pass necessary orders in accordance with law within a period of eight weeks thereafter. If the claim of the petitioner is found to be tenable, particularly in case of the arrears of the pension,

5. With the aforesaid observation/direction, the writ petition stands disposed off.
