The petitioner seeks bail in a case registered for the offence under Sections 272, 273, 414, 120(B)/34 of the I.P.C., Sections 25(1-b)a, 26, 35 of the Arms Act and Section 30(a) of Bihar Prohibition and Excise Act.

One loaded country-made pistol and 7.740 liters of foreign liquor have been recovered from the possession of this petitioner.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent and he is in custody since 28.11.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail

Considering the period of custody of petitioner coupled with the fact that he has got clean antecedent, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Muzaffarpur in connection with Minapur P.S. Case No. 450 of 2021.
