The petitioner is in custody in connection with Narpatganj P.S.Case No.429 of 2016 registered for an offence under Section 302 and ancillary Sections of the IPC. It has been alleged in the FIR that one Birendra Singh and his father were assaulted by as many as fourteen accused persons leading to injuries on his person and death of his father. The informant has received seven injuries on his person whereas the death of his father has been caused by gun shot. Learned counsel for the petitioner submits that because of the land dispute, the petitioner has been falsely named in the case. Patna High Court Cr.Misc. No.60505 of 2017 (2) dt.19-12-2017 2/2 granted bail by different coordinate Benches of this Court in Cr.Misc.No.51561 of 2017 and 43997 of 2017.
The learned APP opposed the submissions.
Considering the clean antecedent of the petitioner and also the fact that similarly situated co-accused persons have already been granted bail by this Court, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ist Additional Sessions Judge, Araria in connection with Sessions Trial No.326 of 2017 arising out of Narpatganj P.S.Case No.429 of 2016.
