Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offence under Sections-147, 148, 149, 188, 341, 323, 307, 332, 333, 504, 353, 427/34 of the Indian Penal Code and Sections-8/20/22/25/29 of the NDPS Act. The prosecution case, in short, is that 1.05 kg. Ganja is recovered.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. It is alleged that 1.05 kg Ganja is recovered from possession of the co-accused. The said recovery of Ganja is below the commercial quantity. So far petitioner is concerned,

Patna High Court CR. MISC. No.16646 of 2020(4) dt.16-11-2021 2/2 he is alleged to have protested against the arrest of co-accused Alakh Singh and his sons. General and omnibus allegation of assault has been made against the accused persons including the petitioner. No specific overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna in connection with Special Case No. 14 of 2020 arising out of Didarganj P.S. Case No. 12 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V.//- U T
